O blogueiro Domingos de Jesus Costa, conhecido como Domingos Costa, foi condenado pela Justiça pelos crimes de calúnia, difamação e injúria contra desembargador José Joaquim Figueiredo dos Anjos. O processo n.° 0849906-98.2022.8.10.0001 resultou na sentença que determina 2 anos e 4 meses de detenção e 42 dias-multa, a ser cumprida em regime aberto, na Casa de Albergados, na capital.
Condenação e Aplicação da Pena
A sentença foi proferida com base no art. 70 do Código Penal, que prevê que, em casos de múltiplos delitos distintos, deve-se aplicar a pena mais grave, aumentada em um sexto. No caso de Domingos Costa, a pena base de 2 anos de detenção pelo crime de calúnia foi elevada em 4 meses, resultando na pena total de 2 anos e 4 meses de detenção e 42 dias-multa.
O valor da multa foi estabelecido em 1/30 do salário-mínimo da época do fato, com correção de juros e correção monetária, a ser recolhido ao Fundo Penitenciário Estadual. A decisão levou em consideração as condições econômicas do réu para determinar o valor da multa.
Substituição da Pena
Como Domingos Costa preenche os requisitos objetivos e subjetivos do art. 44 do Código Penal, a pena privativa de liberdade foi substituída por duas penas restritivas de direitos, que serão determinadas e fiscalizadas pelo Juízo da 2ª Vara de Execuções Penais. Caso o condenado descumpra injustificadamente essas medidas, a pena restritiva de direitos será convertida em privativa de liberdade.
Direitos Políticos
Além da pena de detenção, a sentença suspende os direitos políticos de Domingos Costa pelo período correspondente ao cumprimento da pena de detenção, conforme o art. 15, III, da Constituição Federal e o art. 71, § 2°, do Código Eleitoral.
Procedimentos Finais
Após o trânsito em julgado da sentença, várias providências serão adotadas, incluindo a inscrição do nome do condenado no Livro Rol dos Culpados, a intimação para o pagamento da multa, a comunicação ao Tribunal Regional Eleitoral (TRE) sobre a situação eleitoral de Domingos Costa, e a expedição da carta de guia. Os autos do processo serão arquivados com baixa na distribuição.
